Elara Terms of Service
Last updated: April 27, 2026
Welcome to Elara. These terms explain how the service works, what you can expect from us, and what we expect from you. By joining the waitlist, accepting an invitation to the Elara service, or using the app, you agree to these terms.
Who we are
Elara Travel Inc. (“Elara,” “we,” “us”) operates elara.travel and the Elara application. We help families discover, plan, and book travel.
What Elara does
Elara is a travel planning service for families. We help you discover hotels and destinations, organize your trips, and — when you’re ready — book them. Our travel team is available to advise, answer questions, and handle bookings on your behalf.
When we book a hotel, experience, or other travel service for you, we do so as your booking agent. The contract for the trip itself is between you and the supplier (the hotel, the tour operator, the airline, etc.). Elara may earn a commission from the supplier, but we also book non-commissionable stays when they’re the right fit for you. Either way, you don’t pay Elara a fee for booking.
Membership and the waitlist
Elara is currently invite-only. Joining the waitlist doesn’t guarantee access. We invite people to the service in the order and pace that works for our team.
While we’re in our founding member phase, the Elara service is free to use. We may introduce pricing in the future. If we do, we’ll give current members notice before any charges apply, and we’ll explain the change clearly.
Travel regulations differ from state to state. We may decline to onboard waitlist signups, or limit access to certain features of the service, based on the state where you live. If we can’t serve you for that reason, we’ll let you know.
Your account
To use Elara, you’ll need to provide accurate information about yourself and your family. You’re responsible for keeping your account information up to date and for anything that happens under your account. If you think someone has accessed your account without permission, let us know right away.
You must be at least 18 years old to have an Elara account.
Bookings
When you ask us to make a booking, here’s how it works:
- You tell us what you want to book (a hotel stay, an experience, a tour).
- We confirm the details with you, including price, dates, and any cancellation terms specific to that booking.
- You authorize us to make the booking on your behalf and to use your payment information for that purpose.
- We make the booking with the supplier using your payment details. The charge appears on your card from the supplier (or, in some cases, from a booking system like Sabre).
Once a booking is confirmed, the cancellation, change, and refund terms are set by the supplier. Some bookings are non-refundable. Some allow changes only up to a certain date. We’ll always tell you these terms before you authorize the booking. After that, the supplier’s rules apply.
Prices, rates, and availability shown in the app or quoted by our travel team are not guaranteed until the supplier confirms the booking. Suppliers update their inventory constantly, and a rate that’s available when you start planning may not be available when you’re ready to book. If a price or availability changes between when you ask us to book and when the supplier confirms, we’ll let you know before charging your card.
If something goes wrong with a booking — a hotel cancels on you, a room isn’t what was promised, your travel plans change — let us know. We’ll do what we can to help, including talking directly with the supplier on your behalf. But the supplier is responsible for delivering the trip you booked, and any refund or remedy comes from them.
Payment
You pay the supplier, not Elara, for your trip. Elara does not hold your funds.
When you authorize a booking, you’re authorizing us to use your credit card to make the booking with the supplier. Your card is charged according to the supplier’s terms — usually at the time of booking, sometimes at check-in, depending on the property.
Travel documents and health requirements
You’re responsible for making sure you and everyone in your party have the documents and meet the health requirements needed to travel.
This includes:
- Valid passports. For most international destinations, your passport must be valid for at least six months beyond your travel dates.
- Visas, where required by your destination.
- Vaccinations, health certifications, or other entry requirements set by your destination.
- Any documentation required for travel with minors (consent letters, custody documents, etc.).
Requirements change. We may share general information about what’s needed for a destination, but it’s your responsibility to confirm the current requirements with the relevant embassy, consulate, or government source before you travel.
Elara is not responsible if you are denied boarding, denied entry, or otherwise unable to travel because of missing or invalid documentation, failure to meet health or vaccination requirements, or any other eligibility issue.
What we recommend
Throughout Elara — in the app, in the chat, in conversations with our travel team — we share recommendations: hotels we like, places worth going, things worth doing. These recommendations reflect our judgment based on what we know about you and what we think makes a good trip. They aren’t guarantees. Your experience may be different from someone else’s, even at the same property.
Elara may earn a commission from the suppliers we work with, but not all of them, and we also book non-commissionable stays when they’re the right fit for you. We don’t let commission shape our recommendations. We recommend what we think is right for you, not what pays us best.
What we don’t promise
Elara is provided “as is.” We work hard to make the service useful, accurate, and reliable, but we can’t promise:
- That the app will be available without interruption.
- That every recommendation will be a perfect fit for you.
- That suppliers (hotels, tour operators, etc.) will deliver exactly what they’ve described.
- That information in the app — prices, availability, descriptions — is always perfectly current. Suppliers update these things constantly, and there can be a lag.
We’re not responsible for the actions, omissions, or content of the suppliers we work with, or for events beyond our reasonable control (weather, strikes, government actions, force majeure).
Limits on our liability
To the fullest extent allowed by law, Elara’s total liability to you for anything related to the service is limited to the greater of (a) the amount of commission Elara has actually received from your bookings in the twelve months before the issue arose, or (b) one hundred US dollars ($100). We’re not liable for indirect, incidental, or consequential damages.
Your conduct
Don’t use Elara to do anything illegal, harmful, or that interferes with the service or other people’s use of it. Don’t try to access parts of the service you’re not authorized to use. Don’t scrape, copy, or otherwise extract our content for commercial purposes.
Personal use only. Elara is for planning and booking your own travel and travel for your immediate family or household. You can’t use Elara to plan or book travel for clients, customers, or other third parties as part of any business or commercial activity. You can’t resell, sublicense, or otherwise commercialize Elara’s recommendations, itineraries, or services. If you’re a travel professional, advisor, or running any kind of travel-related business, please reach out to us at [email protected] — Elara isn’t currently set up for that, but we’d like to know who you are.
If you violate these terms, we may suspend or end your access to the service.
Our content
The Elara app, the elara.travel website, our recommendations, our written content, and the way we present everything are owned by Elara or our licensors. You can use them for your own personal travel planning. You can’t republish, resell, or otherwise redistribute them.
Hotel and supplier content (descriptions, photos) often comes from the suppliers themselves and belongs to them.
Ending the relationship
You can stop using Elara any time. If you want us to delete your account and your data, email us at [email protected].
We can suspend or end your access to Elara at our discretion, particularly if you violate these terms or if continuing to serve you would be impractical. We’ll generally give you notice unless circumstances make that impossible.
Changes to these terms
We’ll update these terms as Elara evolves. When we make material changes, we’ll let active members know by email and update the “Last updated” date at the top. Continuing to use the service after we’ve notified you of a change means you accept the updated terms.
Disputes
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute arising from these terms or your use of Elara will be resolved exclusively in the state or federal courts located in Delaware.
This applies to disputes about Elara — the service we provide, our recommendations, our app, our communications with you, our handling of your bookings.
It does not apply to disputes about the trips themselves. If you have a dispute with a hotel, tour operator, airline, or other supplier about the travel service they delivered to you — a cancellation, a refund, a problem with the property, an injury, a flight delay — that dispute is between you and the supplier, governed by the supplier’s own terms and the laws of the supplier’s jurisdiction. We’re happy to help you communicate with the supplier, but we’re not a party to that dispute.
